Ladder Requirements on California Construction Sites
Between 2015 and 2026 M Squared Safety evaluated 403,323 individual inspection items across 7,473 job site inspections in California. One ladder item fails more often than anything else we measure at volume.
Close to one ladder in three
Where a ladder needed to be secured against slipping, we checked 880 times. 279 failed. That is 31.7 percent.
It is the highest failure rate of any item we check at volume. Not the most findings, the highest rate. When securing a ladder is called for on a California job site, close to one in three is not secured.
Ladders overall run a 6.1 percent failure rate, 1,434 findings across 23,643 checks. The category looks unremarkable. One item inside it does not.
What the rule actually says
8 CCR 3276(e)(9): the ladder shall be so placed as to prevent slipping, or it shall be tied, blocked, held, or otherwise secured to prevent slipping.
Note the structure. Placement alone satisfies the rule only if the placement itself prevents slipping. On a finished floor, on dust, on a slope, or against a smooth column, it does not, and the ladder has to be tied, blocked or held.
This is not a rule people disagree with. It is a step that gets skipped because the climb is going to take ninety seconds. That is what a 31.7 percent rate looks like from the inside.
The item that hurts people
Securing fails most often. But side rails extending 36 inches above the landing is the ladder item that carried the most serious severity findings in our data: 18 of them, more than any other ladder condition we track.
8 CCR 3276(e)(11) requires that the side rails extend not less than 36 inches above the upper landing surface. Three feet, measured from the landing.
Without it there is nothing to hold at the moment of transition, which is the moment people fall. This item failed 166 times in 919 checks, 18.1 percent, and it is almost always because the ladder on site was the wrong length for the landing height and somebody used it anyway.
What failed, how often, and how to fix it
Every figure below is from our own inspection record. The item wording is the condition assessed; the rate is the share of checks of that item marked as findings.
Top rails secured to prevent slippage
279 findings in 880 checks. 31.7 percent failure rate.
What the inspector is looking at: Whether the ladder is tied, blocked or held at the top. Inspectors check the ladders that are set up and in use, not the ones stacked on the rack.
How to fix it: Tie off at the top when the ladder is placed, not when someone remembers. The failure here is almost never a decision, it is a step that gets skipped because the climb is going to be quick.
What to document: Note secured ladders on the daily walk by location. A ladder that moves during the day gets re-secured and re-noted.
Ladders maintained in good condition
230 findings in 3,316 checks. 6.9 percent failure rate.
What the inspector is looking at: Split rails, bent rungs, missing feet, damaged spreaders, and paint on wooden ladders that could hide a crack.
How to fix it: Pull damaged ladders the moment they are seen. Under 8 CCR 3276(e)(3) a defective ladder must be withdrawn from service and tagged "Dangerous, Do Not Use" or similar. Leaning it against a wall is how it gets used again.
What to document: Keep a tag-out log. The tag is the compliance, the log is the proof.
Side rails extend at least 3 ft above the landing
166 findings in 919 checks. 18.1 percent failure rate.
What the inspector is looking at: Whether the rails clear the landing surface by 36 inches, giving something to hold while stepping off. This item carried 18 serious severity findings in our record, more than any other ladder item.
How to fix it: Measure from the landing surface, not the top rung, and pick the ladder length for the landing height before the ladder goes up.
What to document: Record ladder length against landing height for each recurring access point on the site.
Workers avoid using topcap or the step below topcap
54 findings in 867 checks. 6.2 percent failure rate.
What the inspector is looking at: Feet on the top cap or the step immediately below it. 8 CCR 3276(e)(15)(E) prohibits both, and the step below the topcap is the one crews are surprised by.
How to fix it: Size the ladder to the work. This item fails when the ladder is one size too short and someone makes it work.
What to document: Note the correction and the reason. Repeat findings here usually trace to one undersized ladder on site.
Ladders being used as intended
77 findings in 1,760 checks. 4.4 percent failure rate.
What the inspector is looking at: A stepladder leaned against a wall as a straight ladder, a ladder used as a walk board, a closed stepladder propped up.
How to fix it: Have the right ladder on site for the actual work. Misuse is nearly always a substitution for equipment that is not there.
What to document: Log what was substituted and why, so the equipment gap gets closed rather than repeated.
Area at top and bottom of ladder kept clear
32 findings in 876 checks. 3.7 percent failure rate.
What the inspector is looking at: Material, cords and debris at the base and at the step-off point. 8 CCR 3276(e)(19) requires both ends to be kept clear.
How to fix it: Treat the ladder base as a no-stack zone and mark it if the site is congested.
What to document: Covered by the housekeeping line on the daily walk.
The pattern
Three of the six ladder items above come back to the same root cause: the ladder on site is the wrong ladder for the job. Wrong length for the landing, wrong type for the surface, wrong size so someone stands on the top cap.
Fire protection and hazard communication fail on paperwork. PPE fails on habit. Ladders fail on equipment selection, which is the cheapest of the three to fix and the one most often left to whoever is holding the ladder.

No. 8 CCR 3276(e)(15)(E) states that employees shall not sit, kneel, step or stand on the pail shelf, topcap or the step below the topcap of a step ladder. The step below the topcap is included, which is the part most crews do not expect.
What has to happen to a damaged ladder?
8 CCR 3276(e)(3) requires that ladders which have developed defects be withdrawn from service for repair or destruction, and tagged or marked as "Dangerous, Do Not Use" or with similar language. Setting a damaged ladder aside without tagging it does not satisfy the standard, because the next crew will use it.
Does the area around a ladder have to be kept clear?
Yes. 8 CCR 3276(e)(19) requires that the area around the top and bottom of a ladder be kept clear. This is the least failed ladder item we measure, at 3.7 percent, and it is usually a housekeeping problem rather than a ladder problem.
